End User Licensing Agreement

If you are using a system in which you create an account and log into our application, please first read and agree to our end user license agreement (the "Agreement"). Below is a short summary, followed by the full Agreement. When you are finished, please acknowledge that you understand and agree to its terms by selecting "I Agree" and clicking "Save." If your data is being shared with DARTNet by a third party, such as a health system, only the Privacy Policy at the end of this agreement pertains to you. Summary

1. This software is part of the In4MedCare™ software package, maintained by the DARTNet Institute.
2. DARTNet Applications and In4MedCare™ are not your doctor and shouldn't replace your doctor's advice.
3. DARTNet Applications and In4MedCare™ offer tips for reducing your health risks, but following the tips does not guarantee you will be healthy.
4. This site is protected by copyright. You may not copy or distribute this information without permission.
5. We make no warranties, assume no responsibility for, and are not liable for loss or damages resulting from your use of DARTNet Applications and In4MedCare™.

THE APPLICATION AND SERVICES ARE NOT INTENDED FOR USE IN A MEDICAL EMERGENCY OR IN CASE OF AN URGENT HEALTHCARE NEED.

Children

This Application and the Services are not intended for children under the age of 13. If you are under 13 years of age, please do not use or access this Application or the Services at any time or in any manner. By using this Application and the Services, you affirm that you are over the age of 13. DARTNet does not seek through this Application or the Services to gather personal information from or about persons under the age of 13.

YOU MUST BE 13 YEARS OLD TO USE THE APPLICATION AND SERVICES. YOU MAY NOT USE THE APPLICATION OR SERVICES IF YOU ARE NOT AT LEAST 13 YEARS OLD.

NOT MEDICAL ADVICE

The DARTNet Applications and In4MedCare™ must be used only as specified in this Agreement. DARTNet Applications and In4MedCare™ are not intended to replace or otherwise serve as advice from a medical professional.

LIMITATIONS ON USE SERVICES

THE SERVICES ARE BASED ON AN ANALYTICAL FRAMEWORK THAT MAKES CERTAIN CALCULATIONS, USING AN EVIDENCE-BASED PROCESS, RELATED TO THE DEVELOPMENT AND TREATMENT OF HEALTH CONDITIONS, BASED ON INFORMATION PROVIDED BY THE USER. BECAUSE THERE MAY BE DIFFERENT INTERPRETATIONS OF THE SAME EVIDENCE, MORE THAN ONE EVALUATION COULD RESULT FROM ANY GIVEN MEDICAL CONDITION THAT MAY EXIST. IN ADDITION, ENTERING THE SAME INFORMATION AT DIFFERENT TIMES MAY YIELD DIFFERENT RESULTS.

THE SERVICES ARE NOT INTENDED TO REPLACE OR SERVE AS A CLINICIAN'S JUDGMENT OR TO BE PREDICTIVE OR USEFUL FOR ALL INDIVIDUALS. WHILE THE SERVICES OFFER ONE APPROACH TO EVALUATING A MEDICAL CONDITION, CLINICAL CONDITIONS MAY VARY FROM USER TO USER. MOREOVER, THE CLINICAL CONDITIONS OUTLINED WITHIN THE SERVICES MAY NOT MATCH PRECISELY WITH YOUR CONDITION.

THE SERVICES CANNOT PREDICT IF YOU WILL GET A PARTICULAR DISEASE, NOR IF A DISEASE OR CONDITION WILL WORSEN.

DO NOT USE THE SERVICES OR THE CONTENT PRESENTED ON THE SERVICES TO MAKE A DIAGNOSIS, TREAT A HEALTH PROBLEM OR REPLACE A DOCTOR'S JUDGMENT. THE SERVICES DO NOT AND CANNOT TAKE THE PLACE OF REGULAR MEDICAL CHECK-UPS. IF YOU HAVE ANY CONCERNS ABOUT YOUR HEALTH, TALK TO A DOCTOR. DO NOT DISREGARD OR DELAY SEEKING MEDICAL ADVICE BECAUSE OF SOMETHING YOU READ ON THIS APPLICATION.

Your use must be Legal and Appropriate.

Your use of the Application, Content and Services must comply with all applicable (federal, state, and local) laws, regulations, and ordinances. You may not access our networks, computers, or the Application, Content or Services in any manner that could damage, disable, overburden, or impair them, or interfere with any other person's use and enjoyment. You may not attempt to gain unauthorized access to the Application, Content or Services, other accounts, computer systems, or networks connected to DARTNet, the Application, Content, or Services. You may not use any automated means (such as a scraper) to access the Application, the Content, or Services. Unauthorized access includes using credentials to access the Application, Content or Services. Any attempt by any individual or entity to solicit login information of any other user, or to access any such account, is an express and direct violation of this Agreement and of applicable law, including relevant privacy and security laws and laws prohibiting unfair or unethical business practices.

Security

The DARTNet Applications and In4MedCare™ encrypt and all transmissions to and from the Application to the central server or to your medical care site. DARTNet reserves the right to adjust the level of encryption or methods of encryption from time to time to maintain a health industry recognized level of security for data transmission. The Application database is also encrypted with limited, controlled access. That said, DARTNet cannot guarantee that your data stored in the DARTNet Applications and In4MedCare™ database is protected to current industry standards against third party attempts to illegally obtain the data. DARTNet will work with the appropriate authorities to attempt to recover any illegally obtained data but no guarantees or warranties are provided or implied by the use of this Application.

MODIFICATIONS TO SERVICE

DARTNET RESERVES THE RIGHT AT ANY TIME TO MODIFY OR DISCONTINUE, TEMPORARILY OR PERMANENTLY, THE SERVICES (OR ANY PART THEREOF) WITH OR WITHOUT NOTICE. YOU AGREE THAT DARTNET SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY MODIFICATION, SUSPENSION OR DISCONTINUANCE OF THE SERVICES.

Application Usage Data

DARTNet owns all right, title and interest in and to Application usage data.

Use of de-identified data

DARTNet may use your data, after removal of any data elements that could identify you, to improve the Application, to study the impact of the Application on your medical condition, better understand user patterns or to help answer any other question that the data are capable of answering. Data from the DARTNet Applications and In4MedCare™ may, from time to time, be linked to other third party data concerning your medical care or condition(s) that DARTNet has access to. These data will not contain any identifiable information but may be used as outlined above to improve the system in the support of your medical care.

Privacy

All personal information collected on the Application is governed by DARTNet's privacy policy. Please see below for this policy.

Intellectual Property Rights; Limited License

DARTNet or its suppliers own all intellectual property rights in and to DARTNet Applications and In4MedCare™, the Application, the Content and the Services. You may only use DARTNet Applications and In4MedCare™, the Content and the Services as expressly permitted in this Agreement. Except for the rights expressly granted to you in this Agreement, DARTNet expressly reserves all right, title and interest in and to DARTNet Applications and In4MedCare™, the Content and the Services.

DARTNet grants you a limited, personal, non-exclusive and revocable license to use DARTNet Applications and In4MedCare™, the Content and the Services for their intended purpose and as expressly permitted in this Agreement.

The Content on this Application is protected by copyright: Except as specifically permitted herein, no portion of the Content on this Application may be reproduced in any form or by any means without the prior written permission from DARTNet.

Use of Application Information. Except as otherwise indicated elsewhere on this Application, you may view, copy, print, and distribute documents available on this Application subject to the following conditions:

- The document may be used solely for personal, informational, non-commercial purposes;

- The document may not be modified or altered in any way; and

- Any copy of the document or portion thereof must include the copyright notice and this permission notice.

DARTNet reserves the right to revoke such authorization at any time, and any such use shall be discontinued immediately upon written notice from DARTNet.

Documents specified above do not include the design or layout of this application. Elements of this Application are protected by trade dress and other intellectual property laws and may not be copied or imitated in whole or in part.

WARRANTY DISCLAIMERS

THE APPLICATION, CONTENT, AND SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DARTNET MAKES NO WARRANTIES REGARDING ERRORS OR OMISSIONS AND ASSUMES NO RESPONSIBILITY OR LIABILITY FOR LOSS OR DAMAGE RESULTING FOR THE USE OF THE APPLICATION, CONTENT, OR SERVICES.

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, DARTNET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE CONTENT, DARTNet APPLICATIONS AND In4MedCare™ OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED OR THAT THE APPLICATION, CONTENT, SERVICES OR ANY RELATED INFORMATION TECHNOLOGY THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT MAKE ANY REPRESENTATIONS OR WARRANTIES REGARDING THE USE OR THE RESULTS OF THE USE OF THE APPLICATION, SERVICES, CONTENT, IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY OR OTHERWISE. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

LIMITATION ON LIABILITY

DARTNET CANNOT ANTICIPATE CHANGES AND THEREFORE EXPLICITLY TAKES NO RESPONSIBILITY NOR ASSUMES ANY LEGAL LIABILITY FOR THE CONTINUED ACCURACY OR CURRENCY OF THE INFORMATION OR CONTENT PRESENTED IN THE SERVICES OR ON THIS APPLICATION OR FOR THE MANNER IN WHICH ANY PERSON WHO USES OR REFERENCES IT MAY APPLY THE INFORMATION OR CONTENT TO ANY PARTICULAR USER, NOR FOR THE COMPLETENESS, CLINICAL EFFICACY OR VALUE OR ANY INFORMATION OR CONTENT, RESULT, PREDICTION, TREATMENT, APPARATUS, PRODUCT, OR PROCESS DESCRIBED OR REFERENCED IN THE APPLICATION.

IN NO EVENT SHALL DARTNET BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF DAMAGE.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, DARTNET'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE GREATER OF THE AMOUNT PAID, IF ANY, BY YOU TO DARTNET FOR THE SERVICES OR ONE HUNDRED DOLLARS.

THIS APPLICATION, CONTENT AND SERVICES COULD INCLUDE TECHNICAL OR OTHER INACCURACIES OR TYPOGRAPHICAL ERRORS. DARTNET MAY MAKE IMPROVEMENTS OR CHANGES IN THE PRODUCT(S) OR THE PROGRAM(S) DESCRIBED IN THIS APPLICATION AT ANY TIME.

Indemnification

You agree to indemnify, defend and hold DARTNet and its and their directors, officers, managers, employees, agents and contractors harmless from and against any and all claims, damages, losses, costs (including without limitation reasonable attorneys' fees) or other expenses that arise directly or indirectly out of or from (i) your breach of any term of this Agreement, or (ii) your use of the Application, the Content, the Services.

Export Control Laws; Restricted Rights Legend

Software available on the DARTNet Application is subject to United States export controls. No software from this site may be downloaded or otherwise exported or re-exported (1) into (or to a national or resident of) Cuba, Iraq, Libya, Sudan, North Korea, Iran, Syria, or any other country to which the United States has embargoed goods; or (2) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Denial Orders.

By downloading or using software from this Application, you are agreeing to the foregoing and you are warranting that you are not located in, under the control of, or a national or resident of any such country or on any such list.

All DARTNet products and publications are commercial in nature. The Content, software and documentation available on this Application are "Commercial Items," as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202- 1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are licensed to U.S. Government end users (A) only as Commercial Items and (B) with only those rights as are granted to all other end users pursuant to the terms and conditions herein.

Governing Law and Jurisdiction

By accessing this Application, you and DARTNet agree that all matters relating to your access to or use of this Application shall be governed by the statutes and laws of the state of Kansas, without regard to the conflicts of laws principles thereof. You and DARTNet also agree and hereby submit to the exclusive personal jurisdiction and venue of the Kansas state courts located in Wyandotte County, Kansas and the United States District Court for the District of Kansas with respect to such matters.

PRIVACY POLICY

DARTNET INSTITUTE PROTECTS AND ENCRYPTS PEOPLE'S DATA AND DOES NOT SELL OR SHARE IDENTIFYING INFORMATION WITH ANYONE OTHER THAN PEOPLE AUTHORIZED BY THE USER OR SUPERSEDING AGREEMENTS.
